QUALIFICATIONS MATTER

During his vast 27-year legal career, Mark has practiced law as a prosecutor and as a defense attorney. His current career focuses around District and Superior Court proceedings in Nash, Wilson and Edgecombe Counties with an emphasis on criminal defense, advocating for clients from diverse backgrounds.

Mark also dedicates substantial time working with a variety of civil cases where he represents both plaintiffs and defendants in matters related to contracts, real estate, construction, collections and landlord/tenant disputes.  He has a wealth of trial experience in both criminal and civil court based on trying numerous bench trials and jury trials. Mark has a thorough understanding of both criminal and civil procedure.

Mark’s dedication to upholding the law, ensuring fair proceedings, and protecting the rights of every individual is unwavering. He successfully represents clients with hard work, persistence, and thorough legal analysis. His experiences in both the courtroom and within our community have shaped his commitment to fairness, integrity and equal justice under the law.

Mark Osterhout was born and raised in Durham, NC. After graduating with a BA in Political Science from Belmont Abbey College, he headed to Campbell Law School in pursuit of his childhood dream of practicing law.  After completing law school, Mark spent a few years working as a Commercial Mortgage broker. Mark began his legal career in 1996 as a prosecutor with the Pitt County District Attorney's office. While there, Mark honed his courtroom skills and developed a keen interest in serving the public.

After serving two years as a prosecutor, Mark moved to Rocky Mount to raise his family.  He joined the law firm of Fields & Cooper, PLLC in 1999 and became a Partner in 2001. Mark lives in Rocky Mount with his wife of 26 years, Anna Brake Osterhout, who is a native of Rocky Mount. They have two children, both of whom graduated from Rocky Mount High School and continued their studies at UNC-Chapel Hill.

Access to justice includes working to simplify legal processes and making sure the courts are run efficiently so that cases are resolved in a timely manner.  This includes using alternative dispute resolution programs and community based educational programs that can help address the underlying causes of legal issues. This is what the public should expect.”
